Property Crime Charge
Property crimes in Raleigh and the surrounding areas have become more and more prevalent. People are financially strapped in today’s day and age, and, unfortunately, these crimes are on the rise. Hiring an effective Raleigh robbery, larceny, or breaking and entering lawyer can mitigate the consequences of committing such a crime or having the charges dismissed.
Breaking and Entering
There are two types of breaking and entering: misdemeanor and felony. Both constitute the crime of breaking into a building of another person. The difference between the two lies in the perpetrator’s intent at the time of the breaking. If the person has the intent to commit a felony, such as a larceny, then he/she will be charged with felony breaking and entering. If there is no intent at the time of the breaking, or the intent is formed after breaking into the building, then a misdemeanor breaking and entering is the proper charge.
Larceny
The crime of larceny is the “taking of the property of another with the intent to permanently deprive that person of his or her property.” These crimes range from shoplifting and misdemeanor larceny to felony larceny. More serious crimes are robberies, which consist of the “taking of the property of another by force or threatened or actual use of a dangerous weapon, such as a firearm.” There are a number of different types of robberies. Common-Law robbery is the taking of the property of another by threat or use of force but without the threat or use of a dangerous weapon. Armed robbery is the taking of the property of another with the threat of a dangerous weapon. Robbery with a dangerous weapon is taking the property of another with the use of a dangerous weapon. All of these are serious felonies, and, if convicted, you could face significant active time.
